Initial approach to the protection of personal data in the workplace from the new regulatory framework

Abstract

Information and Telecommunicactions Technologies have an undeniable impact on the evolution of business activities and all types of organizations, with the initial purpose of increasing productive efficiency. This affects traditional labor provision, since it implies, among other factors, the storage, use and processing of data, including personal data. Understanding the transversal nature of this phenomenon, typical of the Information Society, occupies the attention of the field of Law in its doctrinal and regulatory development.

Thus, this article aims to identify the legal foundations of the right to the protection of personal data contemplated in the recent legal regulation in Cuba, and explore its impact in th field of work relationships, particularly in some of the main moments of the legal employmenty relationship, frome the stage prior to formalizations, until its termination. Its conceptualization as a fundamental right, of autonomous nature, is then understood; it is also concluded, the importance of its observance by employers, in respect of the fundamental rights of workers, and for the achievement od business sustainability, in line with the international policies and agendas. related to sustainable development.
